What to Do with Title II? Interesting and Unique Accessibility Considerations for State and Local Government Entities

Summary
The course will discuss unique methodologies and factors pertaining to accessibility with state and local government facilities. The presentation will also address the differences found in the regulations in how services for people with disabilities might be provided. We will also discuss possible rationales for the differences found in Title II for architectural accessibility. *Learning Objectives: Participants will acquire an understanding of 1) why we need to view accessibility through a slightly different lens for Title II, 2) the different methods these entities can explore to provide accessibility, 3 how to analyze potential methods to achieve accessibility without physical changes, and 4) the importance of having familiarity with the regulations and not only the technical requirements.

Prioritizing Pedestrian Accessibility and Safety, the ADA & PROWAG

Summary
The course will discuss why pedestrian accessibility for people of all abilities is an essential element of transportation for people with disabilities necessary to access their rights covered by Titles II and III of the ADA. The presentation will also address the danger and risks for pedestrians in public rights-of-way which are statistically greater for people with disabilities. A summary of the updates (i.e., final rule from Access Board, August 8, 2023) to the latest version of the Public Right-of-Way Accessibility Guidelines (PROWAG) will be included in the presentation. We will discuss the rationale for the application of PROWAG, rather than ADA Standards, for the design of accessible pedestrian spaces, while acknowledging the long-delayed and pending adoption of these critically needed guidelines. *Learning Objectives: Participants will acquire an understanding of 1) why we need accessibility designs specific to pedestrian spaces in public rights-of-way, 2) what updates and clarification have been made to PROWAG, including the integration of MUTCD specifications, 3) how improving design features of transportation facilities to include greater accessibility can improve safety for all pedestrians, and 4) the importance of prioritizing pedestrian accessibility in the initial design multimodal projects.
